Terms of Service

These Terms of Service govern access to and use of the Taqyid platform, a SaaS solution for Halal compliance management.

1. Acceptance of the terms

By accessing Taqyid, you accept these Terms of Service without reservation. If you do not agree with these terms, please do not use the service.

2. Description of the service

Taqyid is a B2B SaaS platform that allows companies to:

  • Manage their Halal certificates (JAKIM/MYeHALAL)
  • Automate internal and external audits
  • Ensure traceability of raw materials
  • Centralize compliance documentation
  • Track suppliers and their certifications
  • Manage the Halal Assurance System (HAS)

3. Registration and user account

3.1 Account creation

Access to Taqyid requires the creation of an account. You agree to provide accurate and up-to-date information.

3.2 Account responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out through your account.

3.3 Early access phase

During the early access phase, access is free and limited to a restricted number of users. Taqyid reserves the right to select participants.

4. Use of the service

4.1 Authorized use

You agree to use Taqyid only for:

  • Managing your own Halal compliance
  • Legitimate professional purposes
  • Compliance with JAKIM/MHMS 2020 standards

4.2 Prohibited use

It is strictly prohibited to:

  • Use the service for illegal or fraudulent purposes
  • Attempt to access other users' data
  • Disrupt or degrade the operation of the service
  • Copy, modify or distribute the source code
  • Resell or sub-license the service
  • Use the service to build a competing product

5. Intellectual property

All elements of the Taqyid platform (source code, design, logos, trademarks, content) are the exclusive property of DIGIQUEST CONSULTING, operating under the brand name Taqyid. Any unauthorized reproduction is prohibited.

The data you upload remains your property. You grant DIGIQUEST CONSULTING a limited, non-exclusive licence to use it solely for the operation and improvement of the service. This licence terminates upon account termination.

6. Data protection

Your data is processed in accordance with our Privacy Policy and our Data Processing Agreement (DPA), in compliance with the GDPR and the Malaysian PDPA 2010 (as amended in 2025). You have the right to access, rectify, port and delete your data.

7. Pricing and payment

7.1 Early access phase

During the early access phase, access is free. Future commercial terms will be communicated before any billing starts.

Early access programme

The Taqyid early access programme is available free of charge to the first 50 founding organisations until 31 July 2026. During this period, all platform features are accessible without payment or credit card. Taqyid reserves the right to end the early access programme at any time by providing at least 30 days' written notice to participants via email. Upon conclusion of the early access period, participants will be invited to select a paid subscription plan. Users who do not subscribe within 30 days of the end of early access will have their accounts suspended, with a further 30-day period to export their data before permanent deletion.

Founding rate guarantee ("rate-lock for life")

Organisations that join Taqyid during the early access period (the first 50 founding organisations) benefit from a rate-lock guarantee: the subscription price at the time of their first paid subscription will remain unchanged for the duration of their continuous, uninterrupted subscription. This guarantee is subject to the following conditions:

  • The subscription must remain active and continuous. Any cancellation, non-payment, or interruption exceeding 30 days will terminate the rate-lock guarantee. If the user resubscribes after such interruption, the subscription price in effect at the time of resubscription will apply.
  • The rate-lock applies to the base subscription price for the selected plan. It does not cover additional services, add-ons, or features introduced after the initial subscription that are priced separately.
  • DIGIQUEST CONSULTING reserves the right to modify the rate-lock guarantee terms with at least 90 days' prior written notice. In such case, founding members may choose to terminate their subscription without penalty before the new terms take effect.

7.2 Business model

Taqyid operates on a monthly or annual subscription model (ijārah), in line with Islamic finance principles. In the event of late payment, a flat-rate recovery indemnity of EUR 40 may apply in accordance with Article L441-10 of the French Commercial Code. No interest (riba) is charged.

8. Confidentiality

Each party undertakes to keep confidential all information of a confidential nature — including business data, technical specifications, and compliance records — disclosed by the other party in connection with the service. This obligation survives termination for a period of three (3) years.

Customer data stored on the platform is treated as confidential and is accessible only to authorised personnel on a need-to-know basis.

9. Service Level Agreement (SLA)

9.1 Availability target

Taqyid targets a monthly uptime of 99.5%, measured as the percentage of minutes the platform is available during a calendar month, excluding scheduled maintenance windows.

9.2 Scheduled maintenance

Planned maintenance will be communicated at least 48 hours in advance via email or in-app notification. Maintenance windows are excluded from uptime calculations.

9.3 Service credits (post-early access)

After early access, if monthly uptime falls below 99.5%, affected customers on paid plans will receive a service credit equal to 5% of their monthly fee for each additional 1% of downtime, up to a maximum of 30% of the monthly fee. Credits must be requested within 30 days and are applied to the next billing cycle.

9.4 Technical support

During early access, dedicated support is provided via email (contact@taqyid.com). After early access, support will be included in paid plans with defined response times per plan tier.

10. Liability and warranties

10.1 Limitation of liability

To the maximum extent permitted by applicable law, DIGIQUEST CONSULTING shall not be liable for:

  • Decisions made on the basis of data from the platform
  • Indirect, incidental, or consequential losses, including loss of profit, revenue, data, or business opportunity
  • Interruptions due to external causes (network failures, third-party services, etc.)
  • Actions by users that violate these Terms of Service

10.2 Liability cap

In all cases, DIGIQUEST CONSULTING's total aggregate liability under these Terms shall not exceed the total fees paid by the customer during the twelve (12) months immediately preceding the event giving rise to the claim. During the free early access phase, the total liability is limited to EUR 100.

10.3 Early access phase

During the early access phase, the service is provided "as is" without warranty of any kind, either express or implied. Bugs or malfunctions may occur. Your feedback helps us improve the service.

11. Force majeure

Neither party shall be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to: natural disasters, pandemics, government actions, cyber-attacks, failures of third-party infrastructure, or disruptions to internet connectivity.

The affected party shall notify the other party as soon as reasonably practicable. If the force majeure event continues for more than sixty (60) days, either party may terminate the agreement by written notice.

12. Termination and data export

12.1 Termination by the user

You may terminate your account at any time via your profile settings or by contacting contact@taqyid.com.

12.2 Termination by Taqyid

Taqyid reserves the right to suspend or terminate an account in case of:

  • Violation of these Terms of Service
  • Fraudulent or illegal activity
  • Non-payment (outside the early access phase)
  • Extended inactivity (more than 12 months)

12.3 Data export

Upon termination, you may request an export of your data in a structured, commonly used, and machine-readable format (CSV or JSON) within thirty (30) days of account closure. After this 30-day period, your data will be permanently and irreversibly deleted from our systems, unless retention is required by applicable law.

12.4 Survival

Sections relating to intellectual property, confidentiality, limitation of liability, and applicable law shall survive termination of these Terms.

13. Changes to the Terms of Service

Taqyid reserves the right to amend these Terms of Service. Users will be informed by email at least thirty (30) days before any material changes take effect. If you do not agree with the revised terms, you may terminate your account before the effective date of the changes. Continued use of the service after the effective date constitutes acceptance of the updated terms.

14. Applicable law and jurisdiction

These Terms of Service are governed by French law. Any dispute shall first be subject to an attempt at amicable resolution within thirty (30) days. Failing resolution, the dispute shall be submitted to the competent courts of Vesoul, France.

For customers located in the European Union, mandatory consumer protection provisions of their country of residence shall apply where required by law.
